Fines for Smoking in England

There are fixed penalties and fines set out in the Health Act 2006 for breaking the Smoking Ban in England.

These fines will be well published and either you, your employer or the public building you are smoking in will be liable for a fine if you break the smoking ban.

Smokers Fines

Smoking in smokefree premises or vehicle: a fixed penalty notice of £50 (discounted to £30 if paid within 15 days from the issue of a notice) or a fine by a court not exceeding £200

Fines for Business

Failing to prevent smoking in a smokefree premises or vehicle: a fine by a court not exceeding £2500.

Failure to display no smoking signs in smokefree premises and vehicles as required by the new law: a fixed penalty notice of £200 (discounted to £150 if paid within 15 days from the issue of a notice) or a fine by a court not exceeding £1000

Smoking Ban Enforcement

Enforcement officers from local councils will be working closely with businesses to enforce the Smoking Ban in England to help build understanding of the requirements of the new law. From the 1st of July the enforcement officers will be on duty to enforce compliance of the legislation.
